Clear terms for the app and the web.

The iPhone app is designed to run entirely on your device and does not require an account.

The web app uses a friendAI account and lets you choose, for a conversation, between a Local mode that runs in your browser and a Cloud mode that is processed on our servers and by third-party AI providers. Some features — including cloud replies and voice, syncing across devices, community and sharing features, and purchases — require an account and an internet connection.

You must be at least 13 years old and otherwise legally capable of agreeing to these Terms, and you must meet the minimum age of any platform you use to access friendAI.

If you create a web account, you are responsible for keeping your credentials secure and for activity that occurs under your account. Keep your account information accurate, and tell us promptly if you believe your account has been used without your authorization.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use friendAI for personal, non-commercial use.

You may not copy, sell, sublicense, distribute, modify, reverse engineer, or create derivative works from friendAI except to the extent that applicable law clearly permits it despite this restriction.

If you downloaded the iPhone app through Apple's App Store, your use may also be subject to Apple's applicable store terms and Apple's Standard Licensed Application End User License Agreement, to the extent those terms apply and are not inconsistent with these Terms.

You may use friendAI only in compliance with applicable law and only in ways that do not violate the rights or safety of others. You are responsible for your device security, your local backups, any content you enter, and any decisions you make based on output generated by friendAI.

• Do not use friendAI to break the law, infringe intellectual property rights, harass or harm people, distribute malware, or create or share unlawful or harmful material, including any sexual content involving minors.
• Do not attempt to interfere with friendAI, bypass technical restrictions, scrape or overload the service, or use it in a way that could damage the product or other users.
• When you use cloud features, you must also comply with the usage policies of the underlying AI and infrastructure providers.

You retain whatever rights you have in the content you input and in the content you create through your use of friendAI. These Terms do not give us ownership of your content.

If you choose to make a companion public, share a chat, comment, or otherwise publish content through the web app's community features, you grant friendAI a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content as needed to operate those features. You are solely responsible for content you create or share, and you must not publish content you do not have the right to share. We may remove content and act on reports at our discretion.

Sparks are a virtual item that gives you a limited license to access certain features. Sparks have no cash value, are not your property, are not redeemable for money, and are generally non-transferable and non-refundable except where required by law. We may change Spark pricing, rewards, and availability, and we may expire, adjust, or revoke Sparks in cases of fraud, abuse, or violation of these Terms.

If we offer subscriptions, they are billed through Stripe or, on iPhone, through Apple, and may automatically renew until you cancel. You can manage or cancel a subscription through the billing portal or your App Store account, and applicable taxes may apply. Refunds are handled according to the rules of the applicable platform and applicable law.

The iPhone app and the web app's Local mode run primarily on your device or in your browser. You are responsible for the security and availability of your device, local files, browser storage, and any backups you choose to make.

If you delete local files, clear browser storage, lose access to your device, uninstall the app, or fail to maintain your own backups, that data may be permanently lost. Cloud-synced content is stored on our systems, but we do not guarantee that it will always be available.

Some functions depend on third-party services or platform features, such as cloud AI providers (for example, OpenRouter and the providers it routes to, and Google), payment processing (Stripe), account and database infrastructure (Supabase), model downloads from a third-party host (such as Hugging Face), and Apple-provided features.

We are not responsible for third-party services, their terms, their outages, or your use of external platforms or content delivery providers.

friendAI can produce inaccurate, incomplete, biased, outdated, or inappropriate output.

It is not a substitute for professional advice of any kind, including medical, mental health, legal, tax, financial, or emergency-response advice. You should independently review output before relying on it.

friendAI, its branding, and all related intellectual property are owned by their respective owners and licensors.

These Terms do not give you ownership of friendAI or its branding. All rights not expressly granted are reserved.

We may suspend or terminate your access, or your account, if you violate these Terms or if we reasonably believe your use creates legal risk, security risk, or harm, including by ceasing to offer or update friendAI.

You may stop using friendAI at any time and may delete your web account. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, and indemnity.

To the maximum extent permitted by law, friendAI is provided "as is" and "as available."

We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

We do not guarantee that friendAI will be uninterrupted, secure, or error-free, or that outputs will be accurate, useful, or suitable for your needs.

To the maximum extent permitted by law, friendAI and, if applicable, its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, device access, or business interruption arising out of or related to your use of friendAI.

To the maximum extent permitted by law, the total aggregate liability of friendAI and, if applicable, its affiliates, licensors, and service providers for all claims arising out of or related to friendAI will not exceed the greater of the amount you paid to us for friendAI (including subscriptions and Spark purchases) in the twelve months before the claim arose, or USD $50.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless friendAI and, if applicable, its affiliates, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or related to your content, content you share or publish, your misuse of friendAI, or your violation of these Terms or applicable law.

We may modify, suspend, discontinue, or remove parts of friendAI at any time, with or without notice.

If we change these Terms, we will post the updated version and revise the effective date. Your continued use after the effective date means you accept the revised Terms.
